Introduction

This Addendum supplements the Privacy Statement of Little Arms Studios, Inc. ("we," "us," or "our") and provides additional information regarding the rights of individuals located in the European Economic Area ("EEA") or the United Kingdom ("UK") under the General Data Protection Regulation (EU) 2016/679 ("GDPR") and the United Kingdom General Data Protection Regulation ("UK GDPR"), respectively. This Addendum should be read in conjunction with our main Privacy Statement.

As a data controller, we are committed to respecting and facilitating the exercise of your data protection rights. This document explains each of your rights in detail, the conditions under which they apply, and how you may exercise them.

We process personal data as necessary to perform our contracts with you, including fulfilling orders, delivering products or services, processing payments, and communicating with you regarding these matters..

We may process personal data to identify and contact prospective customers, maintain prospect lists, and evaluate potential business opportunities. Such processing is limited to business contact information and related professional detail and the legal basis for such processing is a legitimate interest in the development and growth of our business.

We may process personal data to send marketing communications, promote products and services, and conduct market research. Where required by applicable law, such processing is based on your consent. Where consent is not required by applicable law, such processing is based on our legitimate interest. As described below, you may object to processing for direct marketing purposes at any time, and we shall cease such processing upon receipt of a valid objection.

Your Rights Under the GDPR and UK GDPR

1. Right to Be Informed

You have the right to receive clear, transparent, and easily understandable information about how we collect and use your personal data and the legal bases for processing.

We fulfill this obligation through our Privacy Statement and this Addendum. If you require any additional information about how we process your personal data, you may contact us using the details provided below.

2. Right of Access

You have the right to obtain confirmation as to whether we are processing your personal data and, where that is the case, to obtain access to that personal data along with certain other information.

Upon your request, we will provide you with a copy of your personal data undergoing processing. For any further copies requested by you, we may charge a reasonable fee based on administrative costs. Where you make the request by electronic means, and unless you request otherwise, the information will be provided in a commonly used electronic format.

3. Right to Rectification

You have the right to obtain from us without undue delay the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you also have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

If we have disclosed the personal data in question to third parties, we will inform those third parties of the rectification where possible, unless doing so proves impossible or involves disproportionate effort. Upon your request, we will inform you about those third parties.

4. Right to Erasure ("Right to Be Forgotten")

You have the right to obtain from us the erasure of personal data concerning you without undue delay

This right is not absolute. We may refuse to comply with a request for erasure in certain instances.

5. Right to Restriction of Processing

You have the right to restrict processing if you contest the accuracy of the personal data, for a period enabling us to verify the accuracy of the personal data; the processing is unlawful and you oppose the erasure of the personal data and request the restriction of its use instead; we no longer need the personal data for the purposes of the processing, but you require the data for the establishment, exercise, or defense of legal claims; or if you have objected to processing in certain instances, pending the verification of whether our legitimate grounds override yours.

Where processing has been restricted, such personal data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest.

We will inform you before the restriction of processing is lifted.

6. Right to Data Portability

You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format and have the right to transmit that data to another controller without hindrance from us, where the processing is based on your consent or on a contract to which you are a party, and the processing is carried out by automated means.

In exercising this right, you have the right to have the personal data transmitted directly from us to another controller, where technically feasible. This right shall not adversely affect the rights and freedoms of others.

7. Right to Object

You have the right to object, on grounds relating to your particular situation, at any time to the processing of personal data concerning you which is based on processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority or processing necessary for the purposes of legitimate interests pursued by us or by a third party). This includes profiling based on those provisions.

Upon such objection, we will no longer process the personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms or for the establishment, exercise, or defense of legal claims.

Where personal data is processed for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing. If you object to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes. This right is absolute, and we will cease processing for direct marketing purposes upon receipt of your objection.

8. Rights Related to Automated Decision-Making and Profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.

We do not currently engage in solely automated decision-making that produces legal effects concerning you or similarly significantly affects you. If this changes, we will update this Addendum and our Privacy Statement accordingly.

9. Right to Withdraw Consent

Where we rely on your consent as the legal basis for processing your personal data, you have the right to withdraw that consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

When submitting a request, please provide sufficient information to enable us to verify your identity and locate your personal data. We may request additional information to confirm your identity before processing your request.

Response Time

We will respond to your request without undue delay and in any event within one month of receipt of the request. If your request is complex or we receive a large number of requests, we may extend this period by up to two additional months, in which case we will inform you of the extension and the reasons for it within one month of receiving your request.

Fees

We will provide information and take action on your requests free of charge. However, if your requests are manifestly unfounded or excessive, in particular because of their repetitive character, we may charge a reasonable fee taking into account the administrative costs of providing the information or taking the action requested, or we may refuse to act on the request.

Right to Lodge a Complaint with a Supervisory Authority

If you believe that our processing of your personal data infringes the GDPR or UK GDPR, you have the right to lodge a complaint with a supervisory authority. In the EEA, you may complain to the supervisory authority in the Member State of your habitual residence, your place of work, or the place of the alleged infringement.
